NOTICE OF LIQUIDATION
OF MAXICARE LIFE AND HEALTH INSURANCE LIQUIDATING TRUST
(MLH Liquidating Trust)
PROOF OF CLAIM FILING DEADLINE:
4:30 P.M. CDT November 16, 2006
To claimants, creditors, policyholders, agents and all other persons who may have claims against Maxicare Life and Health Insurance Liquidating Trust (MLH) formerly Maxicare Life and Health Insurance Company and formerly Armour Life and Health Insurance Company.
A Judgment of Liquidation (the "Judgment") was entered against MLH on April 25, 2006 by the Circuit Court of Cole County, Missouri, in the case of W. Dale Finke, Director of the Department of Insurance of the State of Missouri, in his Statutory Capacity as Rehabilitator, v. Maxicare Life and Health Insurance Company, and Maxicare Liquidating Trust, Case No. 02CV 323192 Division II. W. Dale Finke, Director of the Missouri Department of Insurance has been appointed Liquidator and Dennis C. Eckold has been appointed Special Deputy Liquidator.
Proofs of Claims must be received by the Liquidator on or before November 16, 2006 at 4:30 p.m. Central Daylight Time (the "Claims Bar Date") or they may not be considered. There will be no payment by MLH for any claim, incident, lawsuit or other matter unless it is properly filed as a Proof of Claim on an official Proof of Claim form, even if it was previously filed with MLH or any other person or official of MLH. Coverage by State Guaranty Associations may be available for all or part of the policy benefits in accordance with applicable state guaranty laws.
All claimants must file a Proof of Claim with the Liquidator for each known claim (including any return premium or loss claim) or possible claim (policyholder protection claim) to preserve rights to payment. Third-party claimants who are not MLH policyholders, insureds or providers must file Proofs of Claim with the Liquidator in order to preserve any right to payment from MLH. There must be an original signature on the Proof of Claim, as well as dates of all medical services, date of death or services. Completed Proofs of Claim should be mailed to the Liquidator at the address below. The Proof of Claim will be approved or denied by the Special Deputy Liquidator. A hearing on the Proof of Claim may be required. Appeals may be filed with the Circuit Court of Cole County, Missouri, Division II.
